The High Performance Plastics Company (President : Akira Asano) of SEKISUI CHEMICAL CO.,LTD. (President and Representative Director: Ikusuke Shimizu; hereinafter “Sekisui Chemical”)announced in its release dated April 30, 2026 that a decision had been issued upholding its European Patent EP 2 017 237 B2 (“EP'237”). Sekisui Chemical now announces that, in addition to EP'237, a decision has also been issued upholding its European Patent EP 3 357 888 (“EP'888”).
The German Federal Patent Court dismissed the nullity action brought by Kuraray Europe GmbH (“Kuraray Europe”) against the German portion of EP'888 (Docket No. 3 Ni 4/25 (EP)) on June 23rd, 2026. Kuraray Europe may appeal this decision.
EP'888, as with EP'237, is a patented invention relating to PVB interlayer. As announced in Sekisui Chemical’s release dated May 7, 2025, with respect to EP'237, the Munich District Court in Germany ordered Kuraray Europe to cease manufacturing, offering,using, and other acts in Germany with respect to “Trosifol” The Wedge Acoustic and “Trosifol” The Wedge Acoustic Shadeband (collectively, the “Kuraray Products”), and that injunction is currently being enforced. In light of the decision upholding EP'888,Sekisui Chemical is also considering pursuing damages claims against Kuraray Europe based on EP'888.
In Korea, decisions have also been issued upholding Korean Patent No.1935216(“KR'216”) and Korean Patent No.1935222 (“KR'222”), both of which are patents relating to PVB interlayer, in invalidation trials initiated by Kuraray Korea Ltd. (“Kuraray Korea”). On June 22, 2026, the Korean Intellectual Property Trial and Appeal Board issued decisions upholding both patents (Case No. 2025-424 for KR'216 and Case No.2025-425 for KR'222).
Sekisui Chemical filed preliminary injunction proceedings against Kuraray Korea based on these Korean patents on November 6, 2025 before the Seoul Central District Court,regarding the Kuraray Products, and the proceedings are currently ongoing.
